When the county commissioners decided to erect a new jail in front of Adam Myers's Valley House Hotel, he objected and offered to trade a lot just to the north with this one, provided that it become a public space. The town accepted his offer and built the jail on Myers's lot. The court then entered into an agreement with Myers that “the public will put no building in the public square,” and decreed that it would “remain vacant forever under the laws of this county.” Even a later proposal to erect the town pump was defeated, and the square now serves, as it has since 1813, simply as open space and a playground.
